Official Rules
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. Taste The Bahamas Sweepstakes (the "Sweepstakes") begins at 12:00 a.m., Eastern Time ("ET") September 30, 2024, and ends at 11:59 p.m. ET on October 21, 2024, ("Sweepstakes Period"). Sweepstakes is sponsored by Williams-Sonoma, Inc. d/b/a West Elm (the "Sponsor"), 3250 Van Ness Avenue, San Francisco, California 94109.
ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, who have attained the age of 18 as of the Sweepstakes start date. Employees, officers, and directors of the Sponsor, or American Sweepstakes & Promotion Company, Inc. (the "Administrator"), or CTF BM Operations Ltd. operating as Baha Mar (the "Prize Provider"), or their respective parents, subsidiaries, affiliates, shareholders, distributors, agents, sales representatives, advertising, and promotional agencies (all of the above collectively, the "Released Parties") and members of the immediate family (mother, father, sons, daughters and spouse, regardless of where they reside) and household members of each, whether or not related, are not eligible to participate in the Sweepstakes. Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules. Void in Puerto Rico and where prohibited by law.
HOW TO ENTER: During the Sweepstakes Period, eligible participants are invited to enter the Sweepstakes by visiting the Sponsor's promotional website located at https://www.westelm.com/pages/sweepstakes (the "Website") and completing all the required fields on the Sweepstakes entry form. By successfully completing and submitting the entry form, each entrant agrees to receive future news, promotions, and information from the Sponsor and the Prize Provider and will receive one (1) entry ("Entry") into the Sweepstakes.
LIMIT one (1) per person per email address. Once posted, an Entry cannot be deleted, canceled, or modified. All Entries must be received during the Sweepstakes Period. Neither the Sponsor, the Administrator, nor the Prize Provider is responsible for late, incomplete, misdirected, or delayed entries. By participating, each Entrant consents to the Sponsor's and its agents' use of their personal information for the administration of this Sweepstakes. All Entry information and materials become the property of Sponsor and will not be acknowledged or returned. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which are final and binding in all matters relating to the Sweepstakes.
DRAWING AND NOTIFICATION: One (1) random drawing will take place from all eligible Entries received during the Sweepstakes Period. The drawing will be conducted on or about October 23, 2024, by the Administrator to determine one (1) Grand Prize Winner. The odds of winning the prize depends on the total number of eligible Entries received during the Sweepstakes Period. The potential Winner will be contacted by the Sponsor and/or Administrator by the email address provided on the Entry form. All results are final and binding, subject to these Official Rules. In the event a winning Entry is discovered to be invalid for any reason whatsoever or the person who submitted the winning Entry fails to comply with these Official Rules prior to delivery of the prize, the prize may be forfeited and awarded to an alternate winner. If by reason of a printing, computer or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a computerized random selection to award the advertised number of prizes available. No more than the advertised number of prizes will be awarded.
PRIZE: One (1) Grand Prize winner will receive a Nassau, Bahamas Vacation package for winner and one (1) guest that includes a three (3) night stay for two people at Baha Mar Resort (one room, double occupancy), along with two (2) JetBlue round-trip economy air tickets from a major airport closest to winner's home residence to Nassau. Also included is a beachfront dinner at Marcus at Baha Mar Fish + Chop House. The Approximate Retail Value of the vacation package is $5,000. The Total Prize Pool ARV is $5,000.
The Grand Prize winner is responsible for any additional food and beverage, incidental travel, sales tax, service charges, tips, and any other personal charges, or additional costs due to reserving any higher priced package or any fee applied as a result of a change in the reservation, etc. The prize must be redeemed and used by October 31, 2025. Reservations are based on availability and blackout dates may apply. The Prize winner's guest will be required to sign a Travel Companion and Publicity Release form, and winner and guest must travel together on the same itinerary and each are responsible for securing valid passports and/or any additional required travel documents at their sole expense prior to travel. The actual value of the prize may vary depending on the exact itinerary and based on fluctuations in price for any portion(s) of the prize at time of booking. Any difference between the stated ARV and actual value of the prize will not be awarded.
WINNER IS RESPONSIBLE FOR REPORTING AND PAYING ANY AND ALL INCOME, SALES OR EXCISE TAXES THAT MAY APPLY TO ACCEPTING THE PRIZE; SPONSOR AND PRIZE PROVIDER ARE NOT RESPONSIBLE FOR AND WILL NOT PAY ANY SUCH TAXES.
RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, Entrants agree to release and hold harmless the Released Parties from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of Entries; or (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant's participation in the Sweepstakes or receipt of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. By entering the Sweepstakes, participants consent to the use of their name, likeness, image, and biographical data for advertising and promotional purposes without additional compensation, except where prohibited by law. Sponsor reserves the right to suspend or cancel the Sweepstakes or modify these Official Rules as necessary for any reason or as required by applicable law. Sponsor reserves the right, at its sole discretion, to disqualify from the Sweepstakes, and ban from any future promotions, any person it believes to have intentionally violated these Official Rules or tampered with any element of the Sweepstakes without notice to the disqualified or banned person. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
USE OF DATA: All information submitted by Entrants will be treated according to Sponsor's and the Prize Provider's privacy policies, available at https://www.westelm.com/about-us/privacy-policy.html?cm_re=GlobalLinks-_-Footer-_-PrivacyPolicy and https://bahamar.com/privacy-policy/. By participating in the Sweepstakes and providing your email address or any other applicable contact information, Entrants hereby agree to the collection and usage of their personal information and acknowledge that they have read and accepted both the Sponsor's and the Prize Provider's Privacy Policies.
DISPUTES: By entering the Sweepstakes, Entrants agree that 1.) All disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; 2.) All claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and 3.) Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental, or consequential damages and any other damages, other than for actual out-of-pocket expenses, and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrants and Sponsor or the Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with United States law and the laws of the State of California. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts of California, and Entrants consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
